Chapter 159, PEACE AND GOOD ORDER
ARTICLE II, Public Nuisances [Adopted 10-10-1962]
§ 159-5. Prohibited acts.
J. Install, construct or maintain on any house, pole or wire, any
lamp, electric bulb, spot light or any lighting device, indoor or
outdoor, which throws, extends or shines light rays beyond the property
lines of the owner or lessee of the house, pole or wire, so as to
interfere with the peace, quiet, comfort, sleep or rest of any other
person or persons, or adversely affect the health of any person or

§ 159-6. Penalties for offenses. [Amended 11-14-1973 EN]
Any person or corporation who shall violate any of the provisions of
this article, or fail to comply therewith, or with any of the
requirements thereof, or who shall build or alter or use any building or
land in violation of any detailed statement or plan submitted and
approved hereunder, shall be guilty of a misdemeanor, punishable by a
fine not exceed $500 or imprisonment for a period not to exceed 15 days,
or both. Each day's continued violation shall constitute a separate
additional violation. The owner or owners or lessee of any building or
premises, or part thereof, where anything in violation of this article
shall be placed, or shall exist, and any architect, builder, contractor,
agent, person or corporation employed in connection therewith, and who
have assisted in the commission of any such violation, shall each be
guilty of a separate offense and upon conviction thereof, shall be fined
as herein provided.
§ 167-22. Lighting of premises.
No light on any part of premises licensed hereunder shall be
permitted to shine beyond the property line of the premises. All
exterior lights on such premises shall be equipped with shielding
devices so that the glow emanating therefrom shall be directed only on
and toward such premises.
§ 185-2. Prohibited signs. [Amended 10-20-1986 by L.L. No. 3-1986]
A.No billboards, signs, sandwich signs, flashing signs, rotating signs,
neon signs, movable signs, illuminating signs, spot light signs or other
sign devices shall be erected, constructed or used on any public
highway, street, private road, public or private lot or house, store or
building, whether permanent or temporary, except as provided in this
chapter or as authorized by the Village Board of Trustees.
§ 195-1. Permission required.
No lighting company, utility company, firm, corporation, partnership,
association or individual shall erect, construct or install a spot
light, glare light or excessive light or fixture on any pole, post,
fence or wire in the streets or lots; nor allow or permit the hanging,
exhibiting and swinging of banners and flags in, upon and across and
from one building to another, or on any pole, post, fence or wire in the
Incorporated Village of Atlantic Beach, without the written permission
of the Board of Trustees of the Village of Atlantic Beach.
§ 195-2. Penalties for offenses. EN
A violation of this chapter shall constitute and be punishable as a
misdemeanor and such violation shall be punishable by a fine not
exceeding $500 or by a term of imprisonment not to exceed 15 days, or by
both such fine and imprisonment.

D.The licensee shall not erect or construct any structure, lights or
illumination, permanent or temporary, on the improved or unimproved real
property, without first obtaining the written approval of the Village
Board of Trustees.

C.The swimming pool or hot tub may be lighted by underwater lighting,
properly and legally installed, and the balance of the pool or hot tub
area may be lighted only with nonglaring lights and no later than 11:00
p.m
